Vaccine Injuries

There is a special Vaccine Court for injuries caused by vaccines, and you normally have to file in that Court first.

Vaccine Act Claims

Generally, a Vaccine Act case for injuries must be filed within three years after the first symptoms. For death, a Vaccine Act claim generally must be filed within two years of death and four years of the first symptom for death.

What to do if You or Your Loved One is Injured by a Vaccine

First take care of your or your loved one’s health. You should keep any documents you received from getting the vaccine. Let the health care provider who gave the vaccine know about the reaction. Take pictures or videos of the injury. Listen closely to what the medical providers tell you about what happened and why. You can also ask the physicians about what will happen in the future because of the injuries, but there is no need to talk or ask about a lawsuit or anything like that. It is okay to make notes or a timeline of what happened but if you are doing it in order to talk or show to a lawyer later; write at the top “For a Lawyer.” Don’t post anything on social media or the internet that you wouldn’t want the other side to see. Later on down the line these posts and other internet activity may have to be given to the defendant if it has anything to do with what happened.

If you can, grab a business card from anyone involved in giving the vaccine or treating the injury.
