Do not talk to the other side if you can avoid it, but if you have to talk because of some continuing relationship, let them do most of talking. Only talk if you have to and keep what you say short and accurate.
Communication with Medical Providers
Listen carefully to what you are being told regarding any injury you have and why. You can ask medical providers about what happened and why and what will happen in the future, but there is no need ask about a lawsuit. It is okay to make notes about what is happening or what happened, but your notes may have to be produced to the other side. Be careful about your notes and about what you say, they can become evidence at trial. Be honest with your medical providers and tell them about all of your physical complaints. If they ask you if you had similar problems before, tell the truth, but explain if the problems are worse or different now. Keep your appointments and follow medical advice.
Carefully Consider Your Social Media Posts
Are you a frequent social media user? Don’t post anything on social media or the internet about what happened or your injuries. Later on these posts and other internet activity may have to be given to the other side. Pictures of you doing things that don’t fit with your injuries can be used against you.
