Protect Your Rights
Don’t let special interests threaten or restrict legal action

The rights of the wrongfully injured are in jeopardy.

Insurance companies, drug companies and others push hard to get laws passed attacking your right to sue when you are injured by a negligent person or company.
For medical negligence and wrongful death cases, the pro-insurance corporate interests in Missouri government passed a law saying that people injured or killed by their health care could get no more than certain capped amounts for nonmonetary harm, like emotional and physical pain.

Pro-business interests in Missouri government have expanded their attacks on the rights of Missouri citizens who have been cheated by false advertising, injured by products that were made more than 10 years ago even when the life of the product is advertised as longer, and other restrictions on who you can sue, when and for how much. Big business interests are also pressuring our legislature to shorten the time limit in which Missouri citizens can sue.
Courts can fix unjust damage awards, on a case by case basis. There is no need for the legislature to interfere. In our opinion, most of the so-called outrageous jury verdicts people have heard about are either from misleading corporate influence campaigns or were later reduced by the courts. Some critics say that caps get rid of “frivolous lawsuits,” but the caps only affect lawsuits with big non-monetary losses, not frivolous claims.
We believe most so-called “tort reform” is just a form of protection for insurance companies and big business. Big business wants to hold on to its money, and hates anything — like lawsuits — that takes its money away. Trial lawyers are attacked by big business because trial lawyers are one of the few groups with the power and interest to challenge big business.
We hope you will let your legislators and the media know that you do not support restrictions on the rights of Missouri citizens hurt by carelessness. If regular folks do not fight back, their rights will be taken away.
